The government indicted Ana Ruiz, Jose Aviles, and William Perez for conspiracy to possess with intent to distribute more than five kilograms of cocaine, in violation of 21 U.S.C. Â§ 846. This appeal followed the jurys guilty verdict as to all three defendants. We find no merit in the arguments presented by Aviles and Perez, and affirm their convictions without opinion. See 11th Cir.R. 36-1. Ruiz asserts the district court erroneously refused her jury instruction on a mistake of fact defense. We agree and reverse her conviction.
